TERMS OF SERVICE

1. Parties and Definitions

This Terms of Service Agreement ('Agreement') is entered into between Riza Turkmen ('Developer'), the developer of the Zeeky application ('App'), and the individual using the App ('User').

App: Zeeky AI-powered personal life coach mobile application (iOS and Android)
Service: All features and content provided through the App
User: The individual who downloads and uses the App
Content: Data, messages, activity and transaction records created by the User
Premium: Paid subscription plan

2. Acceptance of Terms

By downloading, registering, or using the App, you represent that you have read, understood, and agreed to all provisions of this Agreement. If you do not accept this Agreement, do not use the App.

If you are under 18, you must obtain permission from a parent or legal guardian.

3. Service Description

Zeeky provides an AI-powered personal life coaching service. The App includes the following features:

AI-powered personal life coach chat interface (powered by GPT-4o)
Voice message feature (on-device speech recognition)
Daily activity tracking and logging system
Income and expense management
Movie and TV show tracking and personalized recommendation system
Weekly summaries and personalized suggestions
Apple HealthKit integration (steps, sleep, heart rate, and calorie data)
Location-based activity logging
Personalized push notification system

The Developer reserves the right to modify, update, or terminate the Service with prior notice.

4. Account Creation and Security

To use the App, you must create an account with a valid email address. Sign in with Apple is also available. You are solely responsible for the security of your account.

Your account may be suspended or deleted in the following circumstances:

Impersonating another person
Providing misleading or false information
Misusing the services
Violating this Agreement

5. Subscription and Payment

5.1 Free Plan

The free plan includes 10 messages per day, limited activity and transaction logging. The GPT-4o-mini model is used on the free plan.

5.2 Premium Subscription

Premium subscription is available under the following plans:

Monthly Plan: 7.99 EUR / month
Annual Plan: 59.99 EUR / year (approximately 37% discount)

Premium subscriptions are purchased through Apple App Store or Google Play. All payments are processed through the respective store's payment infrastructure and are subject to Apple's and Google's terms of service.

Subscriptions automatically renew unless cancelled. To cancel, use the subscription settings in the respective store.

The Premium plan provides access to GPT-4o model, unlimited messages, unlimited activities, movie/show recommendations, and weekly summaries.

5.3 Refund Policy

Refunds for subscription services are subject to the Apple App Store or Google Play refund policy. Refund requests must be directed to the respective store.

6. Permissions and Privacy

The App may request the following device permissions:

Microphone: For the voice message feature (optional)
Location: For location information during activity logging (optional)
Health Data (HealthKit): For health statistics (optional, iOS only)
Notifications: For motivation and weekly summary notifications (optional)

All permissions are optional. You can revoke permissions at any time in device settings. Full privacy policy: zeeky.app/privacy

7. Usage Rules

The following actions are strictly prohibited:

Using the App for illegal purposes
Creating content that could harm others
Attempting to breach the App's security
Sending spam or malicious content
Violating copyright or intellectual property rights
Attempting to access the system using automated tools
Overloading the service infrastructure
Misusing the AI model or attempting to generate malicious outputs

8. Limitations of AI Service

Zeeky's AI coaching service is for general information and motivational purposes only. You acknowledge:

AI suggestions do not constitute medical, legal, or financial advice
Always consult a qualified doctor for health-related matters
Consult a licensed financial advisor for financial decisions
AI responses may be inaccurate or incomplete; critical evaluation is recommended
Movie and show recommendations are for informational purposes; IMDb ratings and content information may vary
Zeeky's recommendations should be evaluated in light of your personal circumstances

9. Intellectual Property

The Zeeky application, logo, design, and content belong to Riza Turkmen and are protected by copyright law.

Content created by users (activity records, messages, etc.) remains the property of the user. However, the user grants permission for this content to be processed for the purpose of providing the Service.

10. Limitation of Liability

The Developer does not accept liability for damages arising from:

Service interruption or temporary unavailability
Data loss or corruption
Consequences of applying AI recommendations
Issues arising from third-party services (OpenAI, Apple HealthKit, OneSignal, etc.)
Technical failures beyond the User's control
Potential inaccuracies in movie/show information

11. Termination of Service

The Developer may terminate your account in the following circumstances:

Violation of this Agreement
Extended inactivity (more than 12 months)
Complete termination of the Service

You may delete your account at any time from the Settings menu within the App. All your data will be permanently deleted upon account deletion.

12. Changes

The Developer reserves the right to modify this Agreement with prior notice. Significant changes will be notified within the App. Continued use of the App after changes constitutes acceptance of the new terms.

13. Governing Law and Dispute Resolution

This Agreement is governed by Turkish law. In the event of disputes, amicable resolution will be preferred. If no agreement is reached, Turkish courts shall have jurisdiction. Rights under GDPR are reserved for users residing in the European Union.
